Realistic or Modern A Second Genesis OOC

So my character concept is at least Red List if not Black List. I think they're probably Black List but I'm not sure. They had an incident with their powers and civilians, but haven't had any involving any civilians since. They're actively resisting any attempts to arrest/capture them, but aren't really committing any crimes beyond that. So they're not really what I would consider to be a supervillain, but fighting off anyone that tries to capture them feels like it would probably land them on the Black List. What do you think?

Couple ways to go about determining this. The "gathering of the party" is dependent on the character's being known to Ryan (as part of his case load, which would range from Greens, Reds, Blues, and Whites - Blacks are seek-and-destroy almost exclusively). Black Listers are typically proven "bad guys" in the sense that they are not merely running from the law, but actively being destructive. Hence, Black Listers more often than not get taken down by a GSD kill-team.

1. Character was approached by GSD following the incident, and was offered the opportunity to join up or submit to surveillance and record processing. In the latter case, he'd be considered a White List, as he is non-affiliated with the GSD and is simply going about his daily life, but they are aware of his existence.
2. If the Character is actively engaging in vigilantism or any other use of his powers without GSD sanction, but not in a "negative" way, he'd be Green.
3. Pre-Red List: Hasn't been brought on board yet, but is actively being pursued.

All right, I don't really want to do this after having practically finished my character, but I'm not going to be able to do this. Some personal stuff has come up and I don't think that I can manage my time well enough for that, college and commit time to this.

1. If he's a criminal, he's either in jail, Red, or scrambling to avoid being shot in the head on a daily basis.
2. If he's a "good guy" but is non-affiliated with the GSD, he'd be Green.
3. Otherwise, doing nothing of note with his life, white.

The plot arc is rather dependent on all characters being at least semi-willing to listen to a GSD agent telling them "You need to come with me, now." Whether or not they like the GSD is up for debate, but some measure of trust is necessary.


To simplify answers for any further questions --

If your character could be conceived of as a "bad guy" according to a policeman, there are essentially three outcomes.
1. Imprisoned within the Citadel (more on that in a bit.)
2. Red List - unhappily or happily.
3. Black List - Actively being sought out by a global surveillance network, and has one, if not more, likely superpowered kill teams seeking them out. Black List characters wouldn't be on Ryan's caseload, as they are considered irredeemable even for the purposes of the Red List.
