Hayden was not in the same room as Sans and Joey as he did not have authorized access to that part of the facility
(You cannot retcon that, as I'm pretty sure Sans is not an avenger, in fact shouldn't you be one of the few people only allowed, plus Tony doesn't know Sans I think...)

(Sans can teleport, and Joey would still let him in with his authorization due to Sans being around a lot longer.)

(I mentioned before that Joey moved to a restricted area of the tower. But it truly was rude nonetheless. I just don't know how Hayden is able to go in and out of Avengers tower so easily especially when uninvited and wanted after turning coats.)
