you're both very close to it but with the quick verbal warning i'd say just a 10 if it's a fail, i'll say roll 1d6 bludgeoning damage, and a DC 8 athletics or acrobatics check to save yourself from going prone

Well in this case definitely yes. Don't get me wrong, the game isn't over if he should die, but it mostly just feels extremely anticlimactic to have him just eat dirt in the very first round of combat :p Might've kind of underestimated the potential damage.
